[摘要]中国消费者协会所点评的保险业十大“霸王条款”其实只有一项属于真正意义上的“霸王条款”,有五项是对保险经营行为的曲解,不属于“霸王条款”,有四项属于不公正理赔行为。借鉴发达国家的经验,对保险“霸王条款”应当采用综合治理的模式,充分发挥审判部门、监管机构、保险公司和消费者四方的作用。对不公正理赔行为,则应当通过构建和谐的保险理赔文化加以解决。 [关键词]不公正条款;理赔文化;综合治理模式 [中图分类号] F840 [文献标识码] A [文章编号]1004-3306(2005)07-0058-03 Abstract: In Dec.2004,China Consumers Association named ten insurance policy terms as unfair terms.After a detailed examination,only one of ten is found to be actually unfair insurance term,five terms are based on misunderstanding of insurance business,and four terms belong to unfair claim practices.In developed countries,the regulating of unfair insurance terms is modeled as a comprehensive method,bringing together court,supervisory authorities,insures and consumers.Cultivating and constructing harmonious claim handling culture is helpful to deter and reduce unfair claim practices.
